Today the Daily Express published yet more propaganda and lies

BIG AND BOLD STRAPLINE -A HUGE drop in the number of people appealing against benefit decisions at tribunal hearings was yesterday hailed as a victory for the Government’s reforms.

There were 32,546 tribunal cases between January and March this year, compared to 155,000 in the same period of 2013.

Official figures reveal an 89 per cent fall in people contesting the decisions to cut, deny or restrict Employment Support Allowance, long-term sickness and disability benefits.

Tribunals contesting Jobseeker’s Allowance decisions also fell 70 per cent this year.

Disability minister Mike Penning said: “Fewer appeals going to tribunal is welcome. Getting more decisions right first time avoids the need for protracted tribunal appeals.”

In October 2013 the DWP changed the rules.  They took away the claimant’s right of appeal to any welfare benefit decision (except Housing Benefit which means the Bedroom Tax still carries automatic right of appeal).  Instead the claimant needs to ask the DWP centrally to reconsider the decision BEFORE the claimant is ALLOWED to appeal.

Yes the Express is comparing chalk and cheese or in lay terms they are lying.  Mike Penning the Disability Minister is most certainly being disingenuous and wildly assumptive  – or in lay terms lying or knowingly talking out of his backside – in his comments in the article.  The facts are that (a) this government has taken away claimants of disability benefits rights away by introducing this “mandatory reconsideration” stage as it is called and (b) Mike Penning (and for some reason “Penning lies” has a certain ring to it) cannot POSSIBLY know this means more decisions are right first time as he claims and (c) he cannot know this means less Tribunals will come out of this.

The simple fact is appeals for disability benefits are being prevented by the October 2013 change by this government and that is why the figures for appeals are lower.

Still don’t believe me reader?  Ok how about the Annual Report of Her Majesty’s Courts and Tribunal Service figures? HMCTS Annual Review was published in February 2014 and guess what reader?  Yes the little table below from page 34 of that report (did I say it was prepared by judges by the way?) contains the official data

In the first 6 months of 2013-14 (April – September), 289,529 appeals have been received and 289,578 cleared.

In 2009/10 the last year before coalition took office 339,213 benefit appeals. By 2012/13 this had increased to 507,131 – an INCREASE OF 167,918 and a 50% INCREASE.

What was that you say Daily Express & Mike Penning? Figures for appeals dropped by 89 per cent?  Oh dear though fair play if you are going to get caught out lying it may as well be a huge whopper of a lie!

The first six months of 2013/14 saw 289,529 appeals – Yes that’s up to the last month before you changed the rules not allowing disabled person to appeal under mandatory consideration – saw 289,529 appeals and on target ceteris paribus for 579,058 appeals or circa 240,000 or 71% more than you ‘inherited.’  Yes strange how the Express and Mike Penning the Disability Minister (Sorry reader I haven’t heard of him either!) choose NOT to use this is what we INHERITED from the last lot here don’t you think?

Yet this is more than catching a Tory rag and a Tory Minister lying reader…C’mon that is so old hat now as they get caught out every day and have been caught out daily for a long time now.  No its about the taxpayer cost of these appeals which has been estimated at a very conservative figure of £1500 per appeal – and £1500 times 240,000 MORE appeals is a measly £360 MILLION INCREASED COST.

I need no go over the many thousands of disabled persons who have died within 6 weeks of being declared fit to work by ATOS and other sham exercises under this coalition or the fact this coalition estimated the 2.2m DLA claimants would go down to 1.7m after the ATOS tests…C’mon reader how they hell can they say half a million wont qualify BEFORE any tests taken!!!…

  1. Firstly, people can no longer appeal benefit decisions immediately after their assessment, the mandatory review process will inevitably slow appeal applications down considerably.

    Secondly, another major reason for fewer appeals is not that the DWP suddenly got better at decision-making, but rather, it’s because of a cruel and despicable move by the government to remove basic rate ESA payments from claimants awaiting the outcome of the mandatory review.

    SPeye Joe takes apart Mike Penning’s lies in the Daily Express that the number of appeals has dropped. In actual fact, they increased under the Tories and the only reason they’ve dropped is because claimants now effectively have to go ask the department’s permission first before they can appeal. So, it’s another egregious lie from a government so crooked that Cameron has to screw his trousers on in the morning (joke @ Hunter S. Thompson about Richard Nixon, but still applicable to this lot of inveterate, invertebrate liars).
    As for the Daily Express in all this, what can you say? It’s an horrific rag now more shrilly Right-wing than the Daily Mail, but without that organ’s mass readership. Its proprietor, Richard Desmond, is a notoriously foul-mouthed porn baron. The impressionists on the comedy show, Dead Ringers, used to portray him as Albert Steptoe, the quintessential ‘Dirty Old Man’ from the classic BBC sitcom ‘Steptoe and Son’. So, the Daily Express – your mark of quality journalism.
